2025 REGULATIONS: IS YOUR OPERATION ALIGNED TO RUN RISK-FREE? HOW TO COMPLY WITH THE NEW CUSTOMS AND FOREIGN TRADE REGULATIONS IN THE DOMINICAN REPUBLIC AND THE U.S.

The regulatory landscape in foreign trade continues to evolve. Both in the Dominican Republic and the United States, authorities have updated their procedures and requirements, including:

  • Increased digital inspections by the Dominican Customs Authority (DGA)
  • Additional security requirements for air and sea cargo
  • Stricter regulations for food, pharmaceutical, and chemical products
  • Stronger traceability and mandatory electronic documentation

IN THE DOMINICAN REPUBLIC, YOU SHOULD BE WELL INFORMED ABOUT:
CUSTOMS LAW 168-21
This law completely updates the country’s customs regime. Some key points for importing and exporting companies include:

  • Mandatory pre-declaration: All goods must be electronically pre-declared before arrival.
  • Facilitated fast-track clearance: For certified operators with consistent compliance.
  • Stronger digital oversight: Enhanced non-intrusive inspections and the use of customs intelligence.
  • Stricter penalties for errors or false documentation.

AUTHORIZED ECONOMIC OPERATORS (AEO):
EPS is in the final stages of obtaining certification under the AEO program, which will place us among the most trusted companies with high standards of security and traceability.
We are committed to helping our clients operate with compliance-driven processes that streamline their logistics.

In the United States, exporters and importers must also consider key regulatory entities:

FDA (FOOD & DRUG ADMINISTRATION):

  • Mandatory registration for companies exporting food, cosmetics, or pharmaceuticals
  • New traceability system for high-risk foods (FSMA Final Rule 204)

TSA (TRANSPORTATION SECURITY ADMINISTRATION):

  • Stricter control over air cargo
  • Requires exporters to work with certified operators as “Known Shippers”

CBP (CUSTOMS & BORDER PROTECTION):

  • Focused on verifying origin, correct classification, and compliance with trade agreements (e.g., DR-CAFTA)
  • Requires complete and accurate electronic documentation
